EPA Issues New Guidance for Companies Seeking to Register Disinfectant Products for Drinking Water Use

In response to requests from prospective pesticide product registrants, the EPA has issued new guidance on disinfectant products for drinking water use. The guidance helps companies better understand the Federal Insecticide, Fungicide and Rodenticide Act (“FIFRA”) pesticide product registration process and how it relates to the Safe Drinking Water Act (“SDWA”) requirements.

FIFRA requires manufacturers of pesticide products (including disinfectants) to generate scientific data for the EPA to evaluate before the product can be registered, distributed and sold. As noted by the EPA, registration or regulatory compliance of a pesticide product or device under FIFRA does not guarantee that the product meets the requirements of other environmental and public health protection statutes, including the SDWA, state, tribal or territorial laws regarding drinking water products. In some instances, companies must submit additional data for disinfectants that are intended for use for drinking water before public water system operators will approve the use of such disinfectants. As such, after satisfying FIFRA’s product registration requirements, the EPA advises that companies consult with relevant state, tribal or territorial authorities to determine any additional procedures required for disinfectant product approval for drinking water use in each such jurisdiction.
